FG Popup Builder — Terms of Service

These terms govern the use of the FG Popup Builder service available at popup.freakingreat.com (the app) and fgpush.com (popup delivery). By creating an account you agree to them.

Provider and contact

The service is operated by [PROVIDER — name, company ID, registered office]. Contact: hello@freakingreat.com.

What the service does

FG Popup Builder lets you create popups (modals, panels, corner cards and notifications), show them on your site via an embedded script, collect contacts through forms and track aggregate statistics of impressions, clicks and conversions.

Account and workspace

Using the service requires an account with a verified email address. You are responsible for keeping your credentials secure; you may invite other members into a shared workspace and you are responsible for who you grant access to.

Beta operation

The service is in beta and provided free of charge, “as is”. Features may change and availability is not contractually guaranteed. Any future pricing will be announced in advance — you will never be charged without actively opting into a paid plan.

Your content and your data

The content of your popups and the contacts collected by your forms belong to you. We use them solely to operate the service for you (storage, display, export) and have no right to use them for our own purposes.

You are responsible for the content of your popups and for collecting contacts lawfully — in particular for informing visitors about the processing of their data and for having a legal basis for any follow-up communication (e.g. newsletter consent).

Prohibited use

You must not use the service to distribute unlawful, deceptive or harmful content, to send spam, to mislead visitors (e.g. popups posing as system messages) or in a way that threatens the operation of the service.

If the terms are breached we may pause a popup or restrict the account; in serious cases we may terminate it. Where possible we will warn you first.

Liability

To the extent permitted by law, we are not liable for damage arising from the use of the free beta service — in particular lost profit, data loss caused by circumstances beyond our control, or temporary unavailability. Statutory rights that cannot be waived remain unaffected.

Termination and data deletion

You may stop using the account at any time and request its deletion at hello@freakingreat.com. Deleting a popup permanently deletes its statistics and collected contacts; you can export your data as CSV beforehand.

Changes to the terms

We may amend these terms, in particular when the service grows or leaves beta. We will announce material changes by email or in the app in advance; continued use after the effective date constitutes acceptance.

Governing law

These terms are governed by the law of the Czech Republic. Any disputes fall under the jurisdiction of the competent courts of the Czech Republic.

Annex: Processing of visitor data (DPA)

By collecting contacts through popups we process personal data of your site's visitors on your behalf. You are the controller of that data and we are the processor within the meaning of Art. 28 GDPR. This annex constitutes the data processing agreement between you and the provider.

Subject matter and duration: storing, displaying and exporting data submitted through your popup forms, for as long as your account exists or until the popup is deleted.

Nature of the data: the fields your form collects (typically an email address), a consent flag, the page URL and the submission time. Data subjects: visitors of your websites.

Instructions: we process the data only on your documented instructions — that is, through the service features you use. We do not use it for our own purposes.

Security: transport is encrypted (TLS), data access is separated per workspace and protected by authentication; only members of your workspace have access.

Sub-processors: Vercel Inc. (hosting and image storage, USA/EU), Neon Inc. (database, USA region — us-east-1), Resend Inc. (transactional account emails, EU region). We will inform you before engaging additional sub-processors and you may object.

Third-country transfers: data is transferred to the USA, relying on an adequacy decision (EU-U.S. Data Privacy Framework) or the providers' standard contractual clauses.

Assistance: we will help you fulfil data subject rights (access, erasure, CSV export) and will notify you of any personal data breach without undue delay after becoming aware of it.

Erasure: deleting a popup or the account deletes the data; after processing ends we irreversibly remove the data unless law requires further retention.
